Terms of Agreement & Conditions

STUDIO POLICY​

By recording with or using any of Third Story Recording's services you agree that Third Story Recording and its employees and owners are not responsible for any session data, recording equipment, musical instruments or any other property left or stored at Third Story's premises, which includes any and all session data.

Third Story Recording is not a storage facility and bears no responsibility for data disappearance whether through Acts of God such as flood, electrical surges, hard drive failure, human error or theft.

We recommend that each client request to have a back-up copy of the sessions made immediately. Session materials left beyond 30 days are subject to deletion at the discretion of the Studio.  Third Story Recording is not responsible for any unrecoverable data.

The client affirms that he/she is the rightful owner or assignee of material to be recorded or reproduced and assumes all responsibility for any copyright/ownership violations that may occur during the recording progress.

Third Story Recording & our employees are not responsible for copyright violations, talent or creative royalties, mechanical reproduction licenses, or any other liabilities for such material. Client also agrees to indemnify Third Story Recording and its employees for any and all claims, costs, losses, detriments and expenses of any kind or nature. Including, without limitation, attorney’s fees and/or court costs incurred by Third Story Recording by reason of any breach or alleged breach of any representation, warranty, or agreement made by client. 

PHOTOGRAPHY

While on Third Story Recordings' premises or while using their services representatives of Third Story Recording may take pictures or video of their clients for personal or professional use. By using Third Story Recordings' services or being on their premises you agree to allow Third Story Recording the use of your image.

STUDIO RULES

• No smoking in the Control Room. Smoking is permitted in the Studio Room at the discretion of the engineer.

• Food and drink is encouraged to be consumed in the lounge and garage area. Food and drink may be brought into the studio but must be kept away from equipment racks, and the recording console.

• No firearms allowed on the premises.

• It is recommended that only individuals essential to the recording be present during the booked time.

• Illegal drugs are strictly prohibited and we reserve the right to refuse service or cancel a session if a client appears to be under the influence.

START/END AND SESSION TIMES

The session clock begins at the scheduled time that both parties agree upon. If you arrive early and the studio can accommodate an early start, then the session clock will begin at that time. If you are late for any reason, you will be charged from the scheduled session start time, with no exceptions. Please call if you are going to be late! Set up time will be billed at regular studio rates unless other arrangements are agreed to. This includes load-in and instrument setup, microphone placement, level setting, media transfer, etc.

CANCELLATION FEE

Cancellations after 48 hours forfeit the deposit.

ACCIDENT WAIVER AND RELEASE OF LIABILITY
Before beginning the session, Clients may be asked to sign a waiver.

By Using Third Story Recordings' services or entering the premises you agree to what is written above.
